END USER LICENSE AGREEMENT

You MUST read the following terms and conditions before using this software.

TERMS AND CONDITIONS

You are hereby licensed to install and use SKY Index Professional under the following terms and conditions:

1. The program is licensed to your COMPANY/ORGANIZATION.

2. Only your COMPANY/ORGANIZATION employees are eligible for support.

3. The PROGRAM may be installed on only ONE computer at a time.

4. The program may contact a SKY Software controlled website at any time for purposes of assuring the program is activated and has a valid license and the program may become deactivated based upon the results of that contact.

5. The computer it is installed on must be a computer that remains on-site.

6. THE PROGRAM MAY BE USED ONLY BY COMPANY/ORGANIZATION EMPLOYEES, PAID CONTRACTORS THAT WORK ONSITE, OR VOLUNTEERS THAT WORK ONSITE AND THAT ARE HELPING WITH COMPANY/ORGANIZATION RELATED WORK.

7. SKY Software will provide free support for a period of one year starting from the date of invoice. After one year, support will still be available on a per incident basis for as long as the product is still within the product's support lifetime. There will be a charge for this support and it will be charged at the current rate set by SKY Software at the time of the request.

8. You may not copy or redistribute the program except to make a backup copy(s) of the installer.

9. This license cannot be sold or transferred.

10. THE PROGRAM MAY NOT BE LOANED OR RENTED.

GOVERNING LAWS

This agreement shall be governed by the laws of the state of Virginia.

DISCLAIMER OF WARRANTY

THE SOFTWARE AND THE ACCOMPANYING FILES ARE PROVIDED "AS-IS," WITHOUT WARRANTY OF ANY KIND, AND ANY USE OF THIS SOFTWARE PRODUCT IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKY SOFTWARE AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKY SOFTWARE OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF SKY SOFTWARE HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY. SKY SOFTWARE'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER THIS EULA SHALL NOT EXCEED FIVE DOLLARS (US$5.00).
